Terms & Conditions
Effective Date: July 9, 2025
These Terms & Conditions (“Terms”) govern all services provided by BoD Creative, a DBA of BoD Group LLC, registered in North Carolina, USA. By engaging with our services, you agree to these Terms.
1. Engagement & Agreement
We work only with a signed agreement. This may be provided as a PDF or a written agreement via email with the client’s full name.
We offer three engagement formats:
- Fixed-price projects
- Hourly billing
- Monthly retainers (ongoing support)
2. Payments

Projects may require:
- 100% upfront payment
- or a 50% deposit and 50% upon completion
- or weekly billing for hourly projects
- Invoices are issued via email (PDF or other preferred formats) and payable to our business account at Relay Bank (BoD Group LLC).
- If the client becomes unresponsive for 7+ days without prior notice, the project will be paused. No refunds will be issued for work already started or completed.
- Refunds are not offered except in rare and exceptional cases, at our sole discretion.
3. Client Responsibilities
- Clients are responsible for providing all necessary content (texts, images, logos, etc.) unless content creation is included in the scope of work.
- Clients are solely responsible for the legal use of all materials they provide.
- Feedback is required within 2 business days after receiving deliverables. Failure to respond within that time may result in automatic project pausing or rescheduling.
4. Scope & Availability
- All services offered are listed on our website or in the project agreement.

Additional requests not listed or agreed upon in advance may:
- Require additional payment
- Be delayed depending on availability
- Post-launch support is available only if included in the project or purchased separately as a support package.
5. Ownership & Rights
- Clients receive full rights to the final approved deliverables only after full payment is received.

We do not transfer ownership of:
- Drafts
- Unused designs
- Internal files (unless separately agreed upon)
- Source files (e.g. Figma, code) are included only if specified in the agreement.
- We reserve the right to showcase the final work in our portfolio unless the client explicitly requests otherwise in writing.
6. Disclaimers & Limitations

We are not liable for:
- Hosting issues or external platform downtime (e.g. Webflow, third-party APIs)
- Errors or issues caused by the client after delivery
- Any loss of revenue, traffic, leads, or business opportunity

All timelines are estimates and may shift due to:
- Client delays (e.g. late feedback, missing content)
- Scope changes
- Technical or scheduling conflicts
- If the client becomes inactive for more than 7 calendar days, the project will be paused and may require a reactivation fee.
7. Termination
- Either party may terminate the agreement by mutual written consent.
- If a project is terminated early, payment for completed work is still due.
- Work-in-progress may be withheld until outstanding balances are paid.
8. Legal & Jurisdiction
- These Terms are governed by the laws of North Carolina, USA.
- Any disputes will be resolved in the applicable courts of North Carolina.
- We reserve the right to update these Terms at any time. The latest version will always be available on our website.
